Riot Guidance for Brokers and Clients

Important Information Regarding the Riots and how they affect insurance cover:

Disturbing images of riots have been on our television screens this week, but what happens if your business or home is directly affected?.

What is a Riot?:

As set out in the Public Order Act 1986, (which covers England, Wales, Scotland and Northern Ireland) a riot is:

  • Twelve or more people present together threatening or using violence for a common purpose that would put fear into a person of reasonable firmness
  • The twelve or more do not need to threaten or use violence simultaneously
  • The common purpose may be inferred by their conduct
  • Committed in private or public place

It is not just about definitions:

The police have a duty to prevent a riot no matter how unachievable this may seem. The Riot Damages Act 1886 makes the relevant police authority responsible for paying compensation for certain property damaged in a riot. That means that money paid out as a result of a riot can be recovered under the terms of the Act.

Why is this important?:

If your insurers pay out on a claim to you due to riot, rather than fire and theft, they are able to recover at least some of this cost elsewhere, so it reduces your claims record which can only be positive when it comes to renewal.Perhaps more importantly if you haven’t got cover for riot you can claim directly from the police authority.

What do I do if I think I might have a claim?:

A detailed claim needs to be submitted within 14 days of the incident to the relevant police authority, so if you have a claim we need to alert your insurers as soon as possible but at the latest within 7 days of the incident. There is a specific form to complete and the correct procedure should be followed to ensure that the available compensation is secured as quickly as possible.

We sincerely hope that you won’t need this advice, but please don’t hesitate to contact us with any questions or concerns you may have.
